The American Bar Association's (Chicago, IL) General Practice,
Solo and Small Firm Division has published "Invention Analysis and
Claiming: A Patent Lawyer's Guide," a new book that presents
information on analyzing inventions and capturing them in a
sophisticated set of patent claims. The ABA said a central theme to the
book is the importance of using the problem-solution paradigm to
identify the 'inventive concept' before the claim-drafting
begins. It includes information on drafting individual claims,
intermediate and narrow-scope claims, definition claims, the claim suit,
including direct infringers, claim diversity, and claim review with
enforcement potential. The final section carries information on
preparing and prosecuting the patent application with information on
writing the summary and background, dealing with claim rejection, claim
amendments and working with the inventor. The book costs $80.
