Daimler Financial Services Americas LLC is about to dismiss its case against Ed Harvey, who owned Continental Express Inc. of Little Rock.
The Farmington Hills, Mich., company sued Harvey and his wife, Bonnie, for not repaying a $1.3 million loan that was due in March, according to the company's lawsuit filed in April in U.S. District Court in Little Rock.
We're not sure if the Harveys paid the entire $1.3 million or if the two sides reached some other settlement.
Ed Harvey couldn't be reached for comment.
Daimler's attorney, Mitchell Berry of Little Rock, also found it difficult to reach the Harveys to serve them with the lawsuit.
Berry thought "these defendants have concealed themselves so that the Summons cannot be served upon them," he wrote in an affidavit. He wanted the judge in the case to issue a warning order so the case could move forward even without service.
The warning order was never issued, though, according to the court files.
If you recall, Continental Express was one of Arkansas' largest private companies until it was sold in December to Celadon Group Inc. of Indianapolis for $24.1 million.
In other Continental news, a sentencing date has been set for Kelly Wooldridge, the former president of the company. It was in January that a U.S. District Court jury in Little Rock found Wooldridge guilty of mail fraud conspiracy but not guilty of credit card fraud. The sentencing will occur in the last week of this month.
