Victim of employer's ploy.(The Case of the Worker Who Lost an Eye)

Wangsa was a victim of the ploy by his employer to avoid being fined by the authorities as he was threatened to be sent back to China should he disclose the facts of the unfortunate incident.

His employer, William Lam, and his supervisor, Wong Ah Loke, should be punished by the authorities with the following:

* To bear all medical expenses incurred by Wangsa

* To offer Wangsa employment in another suitable position

* To give Wangsa paid medical leave for the period he couldn't work as recommended by doctor, and

* Ah Loke should be issued with a warning letter by the company.

If we were the judge for this case, we would compensate Wangsa and our reasons are:

* He was injured while working and this is claimable under the Workman's Compensation Act

* He was under stress as he had suffered from threats and did not know what was the right step to take at that point in time, and

* He changed his statement on his surgeon's advice to tell the truth so that he could claim for appropriate compensation.

The recommended compensation to Wangsa should be S$10,000 excluding the lawyers' fees.--Contributed by Nourah Saleh M Alabdulgader, Human Resources, Capital Market Authority, Saudi Arabia; and Christine Chua, officer, administration & personnel department, Government of Singapore Investment Corporation
